Copyright Policy
We respect the work of creators, and we expect everyone on Hubs to do the same. This Copyright Policy explains how to tell us about content on Hubs that you believe infringes your copyright, how to respond if your content was removed, and how we handle repeat infringers. Hubs is operated by Ascent Collective LLC (“we,” “us”), and copyright notices go to our designated agent.
Sending a copyright notice
If you believe content on Hubs infringes a copyright you own, or one you are allowed to act for, email a notice to our designated agent at contact@ascents.gg. Your notice must include:
- your physical or electronic signature, such as your typed full name;
- the copyrighted work you believe was infringed, or a list if there are several;
- the content you want removed, with enough detail for us to find it, such as a link to the message, post or file;
- your name, mailing address, phone number and email address;
- a statement that you believe in good faith that the use isn’t authorized by the copyright owner, its agent or the law; and
- a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are allowed to act for the owner.
If a notice leaves out any of these, we may not be able to act on it. Under US law, anyone who knowingly makes a false claim that content infringes can be liable for damages.
What happens next
When we receive a complete notice, we remove or disable access to the content and let the person who posted it know. Hub owners and moderators can also remove content from their own hubs.
Counter notices
If your content was removed because of a copyright notice and you believe it was a mistake, or that you had the right to post it, you can email a counter notice to contact@ascents.gg. It must include:
- your physical or electronic signature;
- the content that was removed and where it appeared before it was removed;
- a statement, under penalty of perjury, that you believe in good faith the content was removed by mistake or because it was misidentified;
- your name, mailing address and phone number; and
- a statement that you consent to the jurisdiction of the federal district court for the district where your address is (or, if your address is outside the United States, any judicial district where we may be found), and that you will accept service of legal papers from the person who sent the original notice or their agent.
When we receive a complete counter notice, we send a copy to the person who sent the original notice. Unless they tell us within 10 business days that they have filed a court action to keep the content down, we may restore it 10 to 14 business days after we received the counter notice.
Repeat infringers
We close the accounts of people who repeatedly infringe copyright, in appropriate circumstances. Content removed after a valid notice counts toward this unless it was restored after a counter notice. We may also close an account after a single serious case.
