Terms of Service
These Terms of Service are an agreement between you and Ascent Collective LLC (“we,” “us”), the operator of Hubs. They cover the website, the web app, the desktop app and the mobile apps. By creating an account or using Hubs, you agree to these Terms, our Privacy Policy and our Community Guidelines.
Who can use Hubs
You must be at least 13 years old to use Hubs. When you sign up, you confirm that you are. If you don’t confirm it, we don’t create the account. Some countries set a higher age for agreeing to online services on your own (up to 16 in parts of the European Union). If you are under that age where you live, you may use Hubs only with the consent of a parent or guardian, where the law requires it.
You can’t use Hubs if we have previously removed your account for breaking these Terms, or if the law prohibits you from using it. If you use Hubs on behalf of an organization, you confirm that you are allowed to accept these Terms for it.
Your account
- Give accurate information when you sign up, and keep your password, recovery codes and devices secure. You are responsible for activity on your account.
- An account is for one person. Don’t share it, sell it or transfer it.
- Tell us at contact@ascents.gg if you think someone else is using your account.
- New accounts may have limits for a while. We cap how many accounts can be created at once, and a hub can choose to hold back accounts that are only a few hours or days old.
- We may reclaim or change a handle, hub address or organization name that impersonates someone, infringes someone’s rights, is held only to keep it from its rightful owner or is otherwise misleading, and give it to its verified owner. Some names are reserved for Hubs and its products. Our Names and verification policy explains how this works and how to appeal.
Acceptable use
Follow our Community Guidelines and the rules of the hubs you join. You also agree not to:
- break the law or help anyone else break it;
- harm, exploit or endanger children in any way, or share any content that sexualizes minors;
- harass, threaten, impersonate, defraud or spam people, or share their private information without permission;
- record or transcribe people without the agreement our recording tools ask for and the law requires;
- upload malware, or try to access accounts, hubs or data you are not allowed to see;
- get around our limits, security checks, bans or permissions, including by creating accounts automatically or in bulk;
- overload, disrupt or scrape the service, or use it to build a competing dataset, except through features we provide for that purpose;
- copy, modify or reverse engineer our software, except where the law allows it; or
- infringe anyone’s copyright, trademark or other rights.
Your content
You own the messages, files, posts and other content you create on Hubs. You are responsible for it and for having the rights to share it.
You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, display and transmit your content only as needed to operate Hubs: to show it to the people you share it with, to sync it across your devices, to back it up, to run the features you and your hubs turn on, to keep the service secure and to enforce these Terms. We don’t sell your content and we don’t use it to train AI models. This license ends when your content is deleted from the service, except for copies that remain in backups for a limited time or that other people have already shared or quoted.
Content you choose to make public, such as a public profile, public posts or a public hub page, can be seen by anyone on the internet.
Hubs and the people who run them
Hub owners and administrators set up their hubs, choose who can join and moderate them. If you run a hub, you are responsible for:
- the rules, settings, roles and integrations you set up, including bots, API keys and webhooks that share your hub’s messages with other services, and how you use the moderation tools;
- the features you turn on, such as AI, recordings, GIFs, wallet checks and Hub Packs, and telling your members about them;
- making sure your hub and its members follow these Terms and the Community Guidelines, and acting on reports in your hub;
- getting any consent the law requires, for example before requesting a recording or importing another community’s history; and
- anything you offer your members, including paid memberships, tickets or resources, and honoring what you promise them.
Hub rules can be stricter than ours, but they can’t allow anything these Terms or the Community Guidelines prohibit.
Recordings
A hub owner, administrator or meeting host can ask to record a call. Recording starts only after everyone in the call agrees, and anyone who joins later stays muted until they agree. Don’t record or transcribe a call any other way, for example with a separate app, unless everyone in it knows and agrees and the law allows it. The Privacy Policy explains who can see a recording and when it is deleted.
AI features
Some features use AI, such as recaps, Catch me up and translation. They are off until a hub turns AI on. AI can be wrong, so check anything important before you rely on it. You are responsible for how you use what it writes.
Using your own keys
We are adding a way for hub owners to use their own accounts with AI and some other outside services, by adding their own keys to their hub. An optional mode will use only the owner’s keys, never ours. If you add a key, your agreement with that provider applies to what your hub sends it, you pay that provider for your use, and you are responsible for keeping the key valid. We store keys securely and use them only for your hub.
Wallets
You can link a crypto wallet so a hub can give you roles for holding certain tokens. Linking only proves that a wallet is yours. We never ask for your recovery phrase or private keys, we can’t move your funds and we don’t offer trading. Blockchains are public, and we read balances from them as they are. We aren’t responsible for the value of any token or for what a hub gives in return for holding one.
Hub Packs, GIFs and outside information
Hub Packs add things like scores, weather, release news and card prices, and GIF search shows GIFs from GIPHY. This information comes from other services. We show it as it comes and can’t promise it is accurate, complete or on time. Some packs link to outside sites, such as sportsbooks for people 21 and older where betting is legal. Those sites and their terms are separate from Hubs, and we take no bets.
Moderation, suspension and termination
We may remove content, limit features or suspend or close an account or hub if we believe it breaks these Terms or the Community Guidelines, puts people at risk or exposes Hubs or others to legal harm. Where it is safe and practical, we will tell you what happened and how to appeal. You can appeal through the notices in the app or by writing to contact@ascents.gg.
You can stop using Hubs at any time and delete your account from Settings → Privacy → Account data. The Privacy Policy explains what remains after deletion.
Sparks, Hubs+ and other paid features
Hubs+ is a paid plan for people, and Sparks are paid upgrades. We may also offer plans for organizations, hub upgrades, creator memberships, event tickets or downloadable resources.
- Nothing is charged during the beta. While Hubs is in beta, everything is free for everyone, and you can’t be charged.
- Plans, perks and prices may change before and after the beta. The prices on our pricing page are what we plan to charge, not an offer.
- We will tell you before any charge starts, and you will choose whether to pay. Nothing turns into a paid plan on its own.
- When paid features start, prices, billing periods, renewals, cancellations and refunds will be shown at checkout, and those checkout terms will apply to your purchase along with these Terms. Payments will be processed by our payment processor. We won’t receive your full card number.
When you buy from a hub or creator, that hub or creator is responsible for delivering what they offer. Nothing in these Terms limits refund or cancellation rights you have under the law.
Other services you connect
Some features connect to other services, such as calendars, Steam, Mastodon, GitHub, GitLab, crypto wallets or your organization’s sign-in. You choose whether to connect them, and their own terms and privacy policies apply to them. We aren’t responsible for services we don’t operate.
Beta software
Hubs is under active development. Features may change, move or be removed, and some are labeled as early or beta.
The desktop app is offered as a beta. Beta installers aren’t signed with a verified Apple or Microsoft developer certificate, so your operating system may warn you before opening it. The beta does not install updates automatically: download new versions from our website. Keep your device’s protections turned on, and use the web app in your browser if you prefer not to install a beta.
Our software and brand
Hubs, its software, design and logos belong to us or our licensors. These Terms don’t give you rights to our brand. If you send us feedback or ideas, we may use them without owing you anything.
Copyright
Respect other people’s copyright. If you believe content on Hubs infringes your copyright, send a notice to our designated agent as our Copyright Policy explains. We remove or disable content when we receive a valid notice, and the person who posted it can send a counter notice if they believe it was removed by mistake. We close the accounts of people who repeatedly infringe copyright, in appropriate circumstances.
Disclaimer of warranties
Hubs is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We don’t promise that the service will be uninterrupted, error-free or secure, or that content will never be lost. Keep your own copies of anything important.
Limitation of liability
To the fullest extent the law allows, Ascent Collective LLC will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of Hubs. Our total liability for any claim relating to Hubs is limited to the greater of US$50 or the amount you paid us for the service in the 12 months before the claim.
Some places don’t allow these exclusions or limits, so some of them may not apply to you. Nothing in these Terms limits liability that can’t be limited by law.
Governing law
These Terms are governed by the laws of the State of Illinois, USA, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Illinois, and you and we agree to their jurisdiction. If the law where you live gives you the right to bring a claim in your local courts or under your local law, these Terms don’t take that right away.
Changes to these Terms
We may update these Terms as Hubs changes. We will post the new version here with a new date and a short list of what changed. If a change is significant, we will tell you in the app and ask you to accept the new version before it applies to you. If you don’t agree, you can stop using Hubs and delete your account.
